The FCA & PSR Unite Branch has written to the FCA CEO expressing concerns over the rapid implementation of interim guidance on toilet and shower facilities following the Supreme Court judgment in For Women Scotland v The Scottish Ministers (16 April 2025).
The Branch argued that the FCA’s immediate response is premature, lacks legal backing, and may negatively impact the LGBT+ community. The branch urged the FCA to pause implementation until the Equality and Human Rights Commission (EHRC) finalizes its guidance, citing potential legal risks and uncertainty over how the ruling should be interpreted.
Additionally, the Branch has raised concerns that the FCA did not consult the Staff Consultative Committee or employee networks before making the decision, warning that it could have serious consequences on staff well-being.
The Branch has requested transparency through a formal Equality Impact Assessment and risk assessment, emphasising that workplace infrastructure should be fully considered before policy changes are enforced.
